Terms and Conditions
GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale (hereinafter, the “General Conditions”) govern the purchase of products and services made remotely via the internet through the website www.biagiosanto.com (hereinafter, the “Site”), in accordance with Italian legislation on distance contracts (Legislative Decree No. 70/2003).
The Site is owned by CRAVATTIFICIO ALBA S.r.l., with registered office at Via Lazio, No. 2, 73033 Corsano (LE – Italy), Tax Code / VAT No.: 03873700755, REA No.: LE – 251986.
Prior to placing an order, the Customer is required to carefully read these General Conditions, which are made available on the Site to allow for their reproduction and storage.
Contracts concluded through the Site between CRAVATTIFICIO ALBA S.r.l. and the Customer are governed by these General Conditions and by applicable Italian law. The language available for concluding the contract is Italian.

PRODUCTS
Product features and prices are listed on the individual product pages.
To purchase products, the Customer must complete and submit the online order form, following the instructions provided on the Site. The Customer must add products to the “Cart” and, after reviewing the General Conditions and the Privacy Policy, provide shipping and billing information, select a payment method, and confirm the order.
Order confirmation constitutes a contractual offer. By confirming the order, the Customer acknowledges having read and accepted all the information provided during the purchase process and fully accepts these General Conditions.
The contract is deemed concluded upon acceptance of the order by CRAVATTIFICIO ALBA, which is confirmed via an order confirmation email.
Consumers (i.e., individuals purchasing goods for personal use and not for professional purposes) must print or save a digital copy of these General Conditions, in accordance with Italian legislation on distance contracts.
The Customer is not entitled to compensation or indemnity for any direct or indirect damage to people and/or property.
PRICES
All prices are in Euros and include VAT. Any customs duties are not included in the price.
SHIPPING (Italy and Abroad)
Shipping charges apply to all orders and vary depending on the destination country. When the Customer selects a shipping country, the relevant charges will be updated automatically.
PAYMENT METHODS
The Customer may pay for products and shipping costs by Credit Card or PayPal.

For maximum security, payments are processed directly on the bank’s secure server. The Site does not store credit card details. Through a secure communication system with the reference bank, repeat customers may complete future purchases without re-entering their payment data. SSL encryption is used for secure data transmission.
PayPal
Once the order is confirmed, the Customer will be redirected to PayPal’s website to complete the transaction using either a PayPal account or a payment card (including prepaid cards).
ORDER CONFIRMATION
Upon receiving an order, CRAVATTIFICIO ALBA will verify product availability. If any items are unavailable, Customer Service will promptly notify the Customer, who may choose to proceed with or cancel the order.
An email confirming receipt of the purchase order is sent at the time the contract is executed. This email includes a summary of applicable general and specific contract conditions, withdrawal rights, the order number, shipping and billing information, a list of ordered products with essential features, and the total amount paid.
SHIPPING AND DELIVERY
Products purchased on the Site will be shipped to the address provided during checkout.
An invoice will be issued for each order, in either paper or digital format, based on the billing information provided during purchase. No changes can be made to the invoice after it has been issued.
Shipping fees are borne by the Customer and are clearly shown during checkout.
All orders are shipped via express courier Monday through Friday, excluding holidays. CRAVATTIFICIO ALBA is not responsible for unforeseeable delivery delays.
Once products are shipped, the Customer will receive a confirmation email with a tracking link.
Unless otherwise stated or in the case of force majeure, orders will be delivered within 7 business days in Italy and abroad from the day following the order submission. For “MADE TO MEASURE” products, delivery will occur within 20 business days. If a product becomes unavailable, CRAVATTIFICIO ALBA will inform the Customer within the same timeframe, offering alternatives or a refund.
RIGHT OF WITHDRAWAL
Pursuant to Articles 64 et seq. of the Consumer Code (Legislative Decree 206/2005), the Customer has the right to withdraw from the purchase contract for any reason, without penalty and without explanation.
To exercise this right, the Customer must send written notice to CRAVATTIFICIO ALBA within 14 business days from the date of product delivery.

Customer Service will then provide return instructions.
Withdrawal is subject to the following conditions:
Applies to the entire product (not parts or components).
Return shipping costs are the Customer’s responsibility.
The Customer is responsible for the return until receipt is confirmed.
CRAVATTIFICIO ALBA is not liable for loss or damage during uninsured return shipments.
In case of transport damage, CRAVATTIFICIO ALBA will notify the Customer within 5 business days to allow the filing of a courier claim.
A full refund will be issued within 30 days of return, via credit card reversal or bank transfer (Customer must provide banking details: ABI, CAB, and account number).
The right of withdrawal is void if the product or packaging is not intact, specifically if:
The outer packaging and/or internal product packaging is missing.
The product is damaged due to reasons unrelated to shipping.
In such cases, the product will be returned to the sender at their expense.
NON-CONFORMITY OF PRODUCTS
If products sold by CRAVATTIFICIO ALBA are defective or non-conforming, the Customer must promptly contact customercare@biagiosanto.com .
Products are covered by the legal warranties under Articles 129, 130, and 132 of the Consumer Code. Customers are entitled to repair, replacement, price reduction, or contract termination. These rights expire if the defect is not reported within two months of discovery.
ERRORS
Product information on the Site is regularly updated, but errors may occur.
CRAVATTIFICIO ALBA reserves the right to correct errors or omissions even after an order is submitted, and to update information at any time without notice.

GOVERNING LAW AND JURISDICTION
The sale contract is deemed to have been entered into in Italy and shall be governed by Italian law.
For civil or criminal disputes arising from this distance sales contract:
If the Customer is a consumer, jurisdiction lies with the court of their place of residence or elected domicile in Italy.
In all other cases, exclusive jurisdiction lies with the Court of Lecce (Italy) .
CRAVATTIFICIO ALBA further informs consumer Customers, as defined in Article 3(1)(a) of the Consumer Code, that a European platform for Online Dispute Resolution (ODR) is available at http://ec.europa.eu/consumers/odr/ .
This does not limit the consumer’s right to seek resolution through the competent ordinary court or to use alternative dispute resolution procedures under Part V, Title II-bis of the Consumer Code.
Customers residing in EU Member States other than Italy may also resort to the European Small Claims Procedure under Regulation (EC) No. 861/2007, provided the value of the dispute does not exceed EUR 2,000, excluding interest and costs. The regulation is available at www.eur-lex.europa.eu .
